1. Acceptance of Terms
By creating an account, placing a bid, listing a vehicle, or otherwise using autobid24h.com or our mobile/PWA app (the “Platform”), you (“you” or “User”) agree to these Terms, our Privacy Policy, and our Cookies Policy. If you do not agree, do not use the Platform.
AutoBid may modify these Terms at any time. Material changes will be posted with a new “Last updated” date and, where required by law, sent by email. Continued use after the effective date constitutes acceptance.
2. Eligibility
The Platform is available only to U.S. residents who are at least 18 years old and legally able to form binding contracts. By using the Platform you represent that you meet these requirements, that you are not barred from receiving services under U.S. law (including OFAC sanctions lists), and that all registration information is true and current.
3. Account Registration and Verification
To bid or list, you must register an account, provide accurate information, and complete identity verification (“KYC”), which may include uploading a photo of a government-issued ID and your date of birth. AutoBid may deny, suspend, or terminate accounts that fail verification, appear duplicative, or are linked to prior policy violations.
You are responsible for the security of your credentials and all activity that occurs under your account. Notify support immediately if you suspect unauthorized access.
4. Role of AutoBid (Venue Only)
AutoBid provides an online venue connecting buyers and sellers of vehicles, equipment, and related goods. AutoBid is not the seller of items listed on the Platform unless expressly stated. We do not take title to items, do not provide warranties beyond those required by law, and are not a party to the contract of sale between Users.
5. Listings (Seller Obligations)
- Sellers must own the item, hold clear title, and have legal authority to sell it.
- Listings must be accurate, complete, and contain no misleading photos or descriptions. Known material defects must be disclosed.
- Sellers must comply with all applicable federal and state laws including the FTC Used Motor Vehicle Trade Regulation Rule (Buyers Guide), Magnuson-Moss Warranty Act, odometer disclosure rules (49 U.S.C. § 32705), state title and registration laws, and state lemon laws.
- Dealer sellers must hold a valid dealer license in their state and provide proof on request.
- Sellers grant AutoBid a non-exclusive, royalty-free license to display, reproduce, and promote listing content for the duration of the listing and reasonable post-sale archival use.
- Listing fees, success fees, and the buyer’s premium schedule applicable to your listing are shown at submission and are non-refundable once an auction goes live.
6. Bidding Rules (Buyer Obligations)
- Bids are binding. Each bid is a serious, irrevocable offer to purchase at the bid amount plus applicable fees, taxes, and shipping.
- Buyers are responsible for reviewing all listing details, asking pre-bid questions, and arranging any independent inspection before bidding.
- No shill bidding. You may not bid on your own listing, coordinate bids with the seller, or use multiple accounts to manipulate auction outcomes.
- Anti-snipe extensions may extend the auction’s end time when a bid is placed in the final minutes.
- Retracting or refusing to honor a winning bid may result in account suspension, recovery of fees, and reporting to other marketplaces and applicable authorities.
7. Buy Now and Auction Close
If a listing includes a Buy Now option and a buyer elects to use it before the reserve is met or before bidding reaches that price, the listing may close immediately as sold. Otherwise, the highest valid bid at the end of the auction (subject to reserve, if any) is the winning bid. AutoBid reserves the right to void any bid or auction result obtained through fraud, error, or technical malfunction.
8. Fees, Payments, and Taxes
- Buyer’s premium — winning bidders pay AutoBid a buyer’s premium as disclosed on each listing. Payment is due within the timeframe stated at auction close (typically 48–72 hours).
- Seller fees — listing fees and/or a success fee on sale, as disclosed at listing submission.
- Sales tax, title fees, and registration are the buyer’s responsibility and may be collected by AutoBid at close where required by state law.
- All amounts are in U.S. dollars. Payments are processed by PCI-DSS-compliant third-party processors. Wire transfers may be required for transactions above stated card limits.
- Failure to pay timely may result in late fees, cancellation of the sale, and account suspension.
9. Title Transfer and Vehicle Delivery
Title transfer follows the seller’s state procedures and is the joint responsibility of the buyer and seller. AutoBid may facilitate paperwork but does not warrant the timeliness or acceptance of any title transfer. Shipping can be arranged through our delivery partners or a carrier of the buyer’s choice; ownership and risk of loss generally pass when the title and signed bill of sale are transferred to the buyer.
10. “As-Is” Sales and Inspection
Unless a seller states otherwise in writing, vehicles are sold AS-IS, WHERE-IS with all faults, and AutoBid disclaims all implied warranties including merchantability and fitness for a particular purpose, to the maximum extent permitted by your state’s law. Some states do not allow disclaimer of certain implied warranties on consumer goods; this Section applies to the extent permitted by law.
11. Prohibited Conduct
- Listing stolen property, salvaged titles misrepresented as clean, or vehicles with rolled-back odometers.
- Manipulating auction results, creating fake accounts, or harassing other Users.
- Scraping, mirroring, or otherwise extracting Platform data without written permission.
- Uploading malware, attempting unauthorized access, or interfering with Platform operation.
- Using the Platform for money laundering, sanctions evasion, or any unlawful purpose.
12. Intellectual Property
AutoBid, the AutoBid logo, and the Platform interface are protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable license to access and use the Platform for personal or business use consistent with these Terms. All other rights are reserved.
13. DMCA / Copyright Complaints
AutoBid responds to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). Send notices to our designated agent:

A valid notice must comply with 17 U.S.C. § 512(c)(3). Repeat infringers will have their accounts terminated.
14. Termination
You may close your account at any time by contacting support. AutoBid may suspend or terminate your account immediately if you breach these Terms, engage in fraud, fail to pay, or for any other lawful reason. Termination does not relieve you of obligations already incurred (such as paying for a winning bid).
15. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” AUTOBID DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, AUTOBID’S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID AUTOBID IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS (US$100). AUTOBID IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THESE LIMITATIONS; THIS SECTION APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
16. Binding Arbitration and Class Action Waiver
READ CAREFULLY. Except for small-claims-court matters or requests for injunctive relief to protect intellectual property, you and AutoBid agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Houston, Texas, or by video conference at your option, and judgment may be entered on the award in any court of competent jurisdiction.
YOU AND AUTOBID WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Claims must be brought in your individual capacity.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@autobid24h.com with the subject line “Arbitration Opt-Out” and your name, email, and account ID.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware (without regard to conflict-of-laws rules). For claims not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of state and federal courts located in Harris County, Texas.
18. Indemnification
You agree to indemnify, defend, and hold harmless AutoBid, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (i) your use of the Platform, (ii) your listings or bids, (iii) your violation of these Terms or any law, or (iv) your violation of any third-party right.
19. Electronic Communications and E-Sign Consent
You consent to receive electronic communications from AutoBid (account notices, tax forms, contracts, disclosures) and agree that electronic signatures, contracts, orders, and other records satisfy any legal requirement that such communications be in writing under the federal E-SIGN Act and state Uniform Electronic Transactions Acts.
20. Force Majeure
AutoBid is not liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, acts of war or terrorism, civil unrest, labor disputes, network outages, hardware failures, pandemics, or acts of government.
21. General
- Severability — if any provision is held unenforceable, the remainder remains in force.
- No waiver — failure to enforce any right is not a waiver of that right.
- Assignment — you may not assign these Terms without our written consent; AutoBid may assign freely.
- Entire agreement — these Terms (with the Privacy and Cookies Policies) are the entire agreement between you and AutoBid.
